In spite of the 3 to 0 decision by the New York State Court of Appeals that the evidence against Joseph and Silva Swinton was "legally insufficient", the Queens D.A. insist in feeding them to the Prison Gulag. He kmows that he has no case. Instead of Publicly Apologizing to the Swintons for the Gross Abuse of Power and their Cruel and Inhuman Treatment, he insists in wasting taxpayers money for public relations purposes. Between ACS efforts to feed the profit-driven Foster Care Industry and the Queens DA to feed the Prison Industry, Silva and Joseph Swinton were railroaded into prison. They were sentenced to 6 and 5 years each and their 2 Children were kidnapped and forced into Foster Care (total family destruction). While in prison for more than 3 years, they were brutally attacked by guards and other prisoners. With the help of the prostitute press who demonized them and Court Appointed attorneys who did not represent them properly, a jury found them guilty. On July 6, 2006 the NYS Court of Appeals unanimously found the evidence against them was "legally insufficient".

The Swinton's are a Jamaican Vegetarian couple who had a very premature baby: Ice. Only through the love and patience of her parents she survived. The CPS Division of ACS grabbed the child and took her to Long Island Jewish Hospital. In the Hospital's effort to make an MRI against the parents wishes, Ice went into cardiac arrest and almost died. The Swintons made the mistake of suing the Hospital while the baby was still there. The Queens DA came to the rescue and indicted the Swintons with criminal charges. He is very creative in inventing new ways to criminalize innocent people, specially if they are Black and Latino and on top of that poor; all to feed the ever expanding Prison Industry. Assistant DA Eric Rosenbaum was assigned to criminalize the Swintons. He was successful in his job.
